1. Acceptance of Terms

By accessing and using Futureex.ai ("Platform", "Service", "we", "us", or "our"), you accept and agree to be bound by the terms and provision of this agreement.

2. Description of Service

Futureex.ai provides an AI-powered business automation platform for MSMEs, Kirana stores, creators, and small businesses. Our services include but are not limited to:

  • Online store creation and management
  • WhatsApp and Instagram commerce integration
  • Inventory management
  • Order processing and tracking
  • Payment gateway integration
  • AI-powered business automation
  • Analytics and reporting tools

3. User Accounts

3.1 Registration

To use certain features of the Service, you must register for an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information to keep it accurate
  • Maintain the security of your password
  • Accept all responsibility for activity under your account
  • Notify us immediately of any unauthorized use

3.2 Account Types

We offer different subscription plans:

  • Starter Plan: Free tier with limited features
  • Growth Plan: ₹499/month for expanding businesses
  • Premium Plan: ₹1,999/month for established businesses
  • Enterprise Plan: Custom pricing for large organizations

4. Payment Terms

4.1 Subscription Fees

Subscription fees are billed in advance on a monthly or annual basis and are non-refundable except as required by law or as explicitly stated in our Refund Policy.

4.2 Transaction Fees

In addition to subscription fees, we charge transaction fees on orders processed through the platform:

  • Starter Plan: 8% per order
  • Growth Plan: 5% per order
  • Premium Plan: 3% per order
  • Enterprise Plan: 1-2% (negotiable)

4.3 Payment Methods

We accept payments via UPI, credit/debit cards, net banking, and digital wallets through our integrated payment partners (Razorpay, Stripe).

5. User Responsibilities

You agree not to:

  • Use the Service for any illegal purpose or in violation of any laws
  • Upload or distribute viruses, malware, or any harmful code
  • Attempt to gain unauthorized access to the Service or its systems
  • Interfere with or disrupt the Service or servers
  • Impersonate any person or entity
  • Collect or store personal data about other users without permission
  • Use automated scripts to collect information or interact with the Service

6. Intellectual Property

6.1 Our Property

The Service and its original content, features, and functionality are owned by Futureex.ai and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

6.2 Your Content

You retain all rights to content you upload to the Service. By uploading content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and display your content solely for providing the Service.

7. Data Privacy

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your personal information. By using the Service, you consent to our data practices as described in the Privacy Policy.

8. Service Availability

We strive to provide 99.9% uptime, but we do not guarantee that the Service will be uninterrupted, timely, secure, or error-free. We reserve the right to:

  • Perform scheduled maintenance
  • Implement emergency fixes

9. Limitation of Liability

To the maximum extent permitted by law, Futureex.ai shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses.

10. Indemnification

You agree to indemnify and hold harmless Futureex.ai and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising from your use of the Service or violation of these Terms.

11. Termination

11.1 By You

You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of your current billing period.

11.2 By Us

We reserve the right to suspend or terminate your account if you violate these Terms or engage in fraudulent activity. Upon termination:

  • Your right to use the Service will immediately cease
  • We may delete your data after a 30-day grace period
  • You will not be entitled to any refund of fees already paid

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by email or through the Service. Your continued use of the Service after changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes shall be subject to the exclusive jurisdiction of the courts in [Your City], India.

Our Service integrates with third-party services including but not limited to:

  • Meta (WhatsApp, Instagram, Facebook)
